Biography

Michael specialises in construction and major projects. He has more than 10 years' experience handling complex aspects relating to construction, engineering, maintenance and consultancy agreements for infrastructure projects.

His key areas of expertise include: alliancing; early contractor involvement (ECI); procurement, design and construct; design, construct and maintain; public, private partnerships (PPPs); traditional construct only; managing contractor; and construction management.

Michael provides legal advice on projects across a broad range of industries including transport (road and rail), ports, energy and resources including mining, power generation, oil gas and water as well as other general construction projects including hospitals and civil structures. He has a comprehensive understanding of private and public sector requirements and acts for owners, government departments including local authorities, agencies and corporations, contractors, consultants, superintendents, subcontractors and suppliers.

His dual qualifications in engineering and law, and 8 years' work as a civil engineer, provide Michael with a unique ability to understand the inter-relationship between the technical and legal aspects of projects.

Recent major projects Michael has been involved include:

  • $3 bn redevelopment of the Brisbane Showgrounds
  • $2.5 bn Western Corridor Recycled Water project
  • $1 bn parallel runaway at the Brisbane Airport
  • $420 m Townville marine projects
  • $332 m upgrade to the Port of Brisbane Motorway
  • $2.4 bn development of Clermont and Kestrel mines.

Michael is a regular presenter at seminars. Some of Michael's recent papers and speaking engagements this year include:

  • "Alliance Contracting: An Infrastructure Procurement Option.  An explanation of the strengths and weaknesses of this infrastructure procurement method" held by Bond University for advanced training in Public Private Partnerships (23 June 2010)
  • "ECI: Two Stage Contracts" presentation at a conference called "Early Contractor Involvement in Infrastructure & Major Projects Summit 2010" in Sydney (17 June 2010)
  • "Don't Bet the Company: Limiting Liability with Effective Exclusion and Limitation Clauses" for the AMPLA Queensland State Conference (22 May 2010)
  • "Overview and Use of Liquidated Damages Provisions" for an ALB Masterclass series on Liquidated Damages (24 March 2010)
  • "Contract Drafting: A Guide to Indemnity Clauses" for Legalwise Seminars on "CPD Compliance for Government Lawyers 2010" (10 March 2010)
  • 18 February 2010 – presentation and paper entitled "Limiting Liability with Effective Exclusion and Limitation Clauses" for the 10th Annual Conference Series: Contracts 2010, held by LexisNexis Seminars.

Michael is a member of the Queensland Law Society, United Kingdom Society of Construction Law, Institute of Arbitrators and Mediators Australia, Institute of Public Works Engineering Australia, Engineers Australia and past Executive Secretary to the Queensland Major Contractor's Association.
